By accessing or using ART SA (artsa.com), you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform. These terms apply to all users — collectors, artists, galleries, and visitors.

2. Platform Description

ART SA is a global art marketplace connecting artists, collectors, and galleries. We provide tools for showcasing, discovering, buying, and auctioning original artworks. All transactions are facilitated through our platform with blockchain-verified certificates of authenticity.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. User Roles & Responsibilities

Collectors

As a collector, you may browse, save, purchase, and bid on artworks. All bids placed in auctions are binding commitments. You agree to complete payment for any artwork you purchase or win at auction.

Artists

As an artist, you may submit your work for listing on the platform. You represent that you are the original creator or authorized rights holder of all submitted works. ART SA reserves the right to review and approve artist profiles before publication.

Galleries

As a gallery, you may list and manage artworks on behalf of represented artists. You warrant that you have proper authorization to sell or auction listed works.

5. Purchases & Payments

All prices are listed in USD unless otherwise stated. Payment is processed securely via Stripe. By making a purchase, you agree to:

• Pay the full listed price plus any applicable shipping and taxes
• Provide valid payment information
• Accept our refund and return policies as outlined below

6. Auctions

Live auctions operate under the following rules:

• All bids are final and binding
• A bid placed in the last 5 minutes extends the auction by 5 minutes
• The highest bidder at closing wins the artwork
• Winners must complete payment within 48 hours
• ART SA reserves the right to cancel auctions in cases of fraud or technical issues

7. Shipping & Delivery

All artworks are shipped with white-glove insured delivery. Estimated delivery times vary by location. ART SA is not responsible for delays caused by customs or third-party carriers, though we will work to resolve any issues.

8. Intellectual Property

All content on ART SA — including artwork images, text, design, and code — is protected by copyright and intellectual property laws. Artists retain full ownership of their works. By listing on ART SA, artists grant us a non-exclusive license to display and promote their works on the platform.

9. Prohibited Conduct

You agree not to:

• Submit fraudulent, stolen, or misrepresented artworks
• Manipulate auctions through shill bidding or collusion
• Scrape, harvest, or collect user data without consent
• Use the platform for money laundering or illegal activity
• Interfere with the platform's operation or security

10. Limitation of Liability

ART SA acts as a marketplace facilitator. We do not guarantee the authenticity, quality, or condition of artworks beyond our authentication process. Our liability is limited to the fees collected for the specific transaction in question.

11. Modifications

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance. Material changes will be communicated via email to registered users.

12. Governing Law

These terms are governed by applicable international law. Any disputes shall be resolved through binding arbitration in accordance with international commercial arbitration rules.
